GENERAL TERMS & CONDITIONS 

This addendum forms an integral part of the agreement and the corresponding invoice relating to the trips organized by Roots and Roads Africa.

1. Applicable Law

This agreement is governed by the Belgian Act of 21 November 2017 relating to the sale of package travel, linked travel arrangements and travel services, as well as by Belgian law.

2. Price and Payment

The agreed travel price is based on the rates and exchange rates applicable on the date of the quotation.

Payment must be made according to the terms stated on the invoice.

A deposit of 50% of the total travel price is required.

The remaining balance must be paid no later than 4 weeks prior to departure.

3. Special VAT Scheme

In accordance with Article 1, §7 and Article 53 of the Belgian VAT Code, this trip is invoiced under the special VAT scheme applicable to travel agencies.

VAT is included in the price and is non-deductible.

4. Cancellation by the Traveler

In the event of cancellation by the traveler, cancellation fees may be charged depending on the timing of the cancellation and the costs already incurred with local suppliers.

These costs may amount to up to 100% of the total travel price, in accordance with Article 28 of the Belgian Act of 21 November 2017.

5. Changes and Unforeseen Circumstances

If, due to unforeseen circumstances beyond the control of the travel organizer (such as overbooking, closures, safety concerns, weather conditions, or reduced services from a lodge or local supplier), the organizer is required to modify one or more elements of the trip, the organizer reserves the right to replace these with accommodation, services, or activities of at least equivalent or higher quality.

Such replacements shall not entitle the traveler to any price reduction, nor shall they result in an increase of the agreed travel price, even if the replacement causes additional costs for the travel organizer.

In such cases, the travel organizer shall bear any additional costs resulting from the replacement.

All of the above is in accordance with Article 15 of the Belgian Act of 21 November 2017.

6. Liability

The travel organizer shall not be held liable for damages caused by:

  • force majeure,

  • actions of third parties,

  • or the behavior of the traveler themselves,

as provided under Article 36 of the Belgian Act of 21 November 2017.

7. Disputes

In the event of any dispute, Belgian law shall exclusively apply and only the Belgian courts shall have jurisdiction.
